1. Acceptance of Terms
By accessing or using the services provided by The Peterson Agency ("Company," "we," "us," or "our") at tpaia.com, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use immediately.

2. Services Provided
The Peterson Agency provides AI-powered growth platforms, CRM implementation, voice agent solutions, marketing automation, and related consulting services primarily for nonprofit organizations. Specific deliverables, timelines, and pricing are outlined in individual service agreements or proposals.

3. User Responsibilities
You agree to:

Provide accurate, current, and complete information when engaging our services

Maintain the confidentiality of any account credentials provided to you

Use our services only for lawful purposes and in accordance with applicable laws

Not reverse-engineer, resell, or redistribute any platform, tool, or AI solution we provide without written consent

4. Intellectual Property
All content, tools, workflows, AI agents, templates, and systems developed by The Peterson Agency remain the intellectual property of The Peterson Agency unless explicitly transferred in writing. Custom work product created solely for your organization will be outlined in your service agreement.

5. Payment Terms

Fees for services are outlined in your proposal or service agreement

Invoices are due within the timeframe specified in your agreement

Late payments may result in service suspension

Refunds are handled on a case-by-case basis and are not guaranteed unless specified in your agreement

6. Confidentiality
Both parties agree to keep confidential any proprietary, sensitive, or non-public information shared during the course of the engagement. This obligation survives termination of services.

7. Data & Privacy
We are committed to protecting your data. Our use of your information is governed by our [Privacy Policy], which is incorporated into these Terms by reference. We do not sell your personal data to third parties.

8. AI & Automation Disclaimer
Our AI-powered tools and voice agents are designed to support, not replace, human decision-making. The Peterson Agency does not guarantee specific outcomes from AI recommendations and is not liable for decisions made based on automated outputs.

9. Limitation of Liability
To the maximum extent permitted by law, The Peterson Agency shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you in the 90 days preceding the claim.

10. Termination
Either party may terminate services with written notice as outlined in the applicable service agreement. Upon termination, outstanding fees remain due and all confidentiality obligations remain in effect.

11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California.

12. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services after notice of changes constitutes acceptance of the updated Terms.
